Here we present digest on IDPs and conflict affected persons for August prepared by R2P.  This digest has been produced with the assistance of the UN Refugee Agency (UNHCR) in the frame of the project Advocacy, Protection and Legal Assistance to the Internally Displaced Population.

Highlights:

  • Stanitsa Luhanska entry exit checkpoint (EECP) to the non-government controlled territory (NGCA) was closed on 2-7 September for renovation.
  • Internal military checkpoints were removed in Teple of Stanychno-Luhanskyi raion of Luhansk Oblast, improving freedom of movement in the area.

Here we present digest on IDPs and conflict affected persons for July prepared by R2P. This digest has been produced with the assistance of the UN Refugee Agency (UNHCR) in the frame of the project Advocacy, Protection and Legal Assistance to the Internally Displaced Population.

Highlights:

  • The Court of Appeals judgement on Cabinet of Ministers (CoM) Resolution 365 is not being enforced. The majority of the Departments of Social Protection (DoSPs) continue conducting home visits prior to reinstating social and pension payments.
  • The majority of cases on pension suspension are pending in the courts and will be granted consideration after R2P’s model case judgement is issued (The Supreme Court completed hearings of R2P’s model case concerning the resumption of an internally displaced person’s (IDP) pension payments and arrears from April 2017). The hearing is scheduled for 4 September.
  • R2P released its mid-year review on reasons for and conditions of crossing the line of contact (LoC).

On September 4, 2018, the Grand Chamber of the Supreme Court dismissed the Department of Pension Fund (DoPFU) of Ukraine‘s appeal and upheld the decision of the Supreme Court in the model case concerning the resumption of an internally displaced person’s pension payments and arrears from April 2017. Then DoPFU appealed and lost. Finally, the issue is settled. As it was a model case, the decision of the Supreme Court will also affect tens of thousands of similar cases.

Here we present digest on IDPs and conflict affected persons for June prepared by R2P. This digest has been produced with the assistance of the UN Refugee Agency (UNHCR) in the frame of the project Advocacy, Protection and Legal Assistance to the Internally Displaced Population.

Highlights:

  • Payment of social benefits and pensions remain the greatest concern among IDPs. Instances of secondary legal assistance on pension issues almost doubled.
  • R2P’s model case decision regarding the unlawful suspension of an IDP’s pension rendered on 3 May 2018 by the Supreme Court was appealed by the Pension Fund to the SC’s Grand Chamber. The case will be considered on 4 September 2018.
  • Residents of Travneve and Hladosove in Bakhmutskyi raion of Donetsk oblast and Novooleksandrivka in Luhansk oblast, which are close to the line of contact, obtained the possibility to receive social benefits as local citizens per amended CMU Order 1085 as of 13 June 2018.
  • The Ministry of Social Policy is planning to merge the two databases used by Departments of Social Protection. The database merger is planned for July.
  • DoPFU representatives in 6 oblasts and Kyiv confirm that IDP pensioners can have their pensions delivered via Ukrposhta.

This digest has been produced with the assistance of the UN Refugee Agency (UNHCR) in the frame of the project Advocacy, Protection and Legal Assistance to the Internally Displaced Population. Digest is available in Ukrainian and English languages.

In March, all entry-exit checkpoints (EECPs) to the non-government controlled area (NGCA) extended their working hours from 8:00-17:00 to 7:00-18:30. However, there was a mismatch in working hours for a few days at the Marinka and Maiorske EECPs because the NGCA-side EECPs worked only at 8:00-17:30. The issue was resolved.

Demining activities began in the vicinity of Maiorske EECP in March.

Residents of Novotroitske, Donetsk oblast, report anonymously that military representatives deploy military equipment within the town and recommend residents in the vicinity move out of their homes due to danger. БФ «Право на захист» підготував моніторинговий звіт «Перетин лінії зіткнення через КПВВ» за березнь 2018, який доступний українською та англійською мовами.

У березневому звіті йдеться про проблеми, з якими майже щодня стикалися українські громадяни під час перетину контрольних пунктів в’їзду-виїзду (КПВВ), які розташовані в Донецькій («Майорське», «Мар’їнка», «Гнутове» та «Новотроїцьке») та Луганській («Станиця Луганська») областях. Статистичні дані та аналітика подані у вигляді графіків та діаграм.

Подібно до даних, зібраних у лютому, мешканці контрольованої Урядом України території (КУУТ) мали значно менше причин перетинати лінію зіткнення, ніж мешканці неконтрольованої Урядом України території (НКУУТ). Здебільшого особи, опитані під час перетину лінії зіткнення вказали, що постійно проживають на НКУУТ. Це також збігається зі значною кількістю осіб, які назвали КУУТ пунктом призначення своєї поїздки.

Протягом усіх етапів опитування причини перетину залишаються майже незмінними. Найбільш поширеними причинами для відвідування КУУТ були вирішення питань із документами, зняття готівки та уникнення припинення виплат унаслідок перевищення 60-денного терміну відсутності на КУУТ, у той час, як на НКУУТ найчастіше подорожували аби відвідати родичів.

Мінлива погода та неналежний догляд за дорогою та пішохідною територією на КПВВ «Мар’їнка» спричинили суттєве зростання кількості скарг (з 24.1% у лютому до 49.0% у березні).

[/vc_column_text]Right to Protection CF prepared report “Crossing the line of contact” for March 2018 which is available in English and Ukrainian languages.

The monitoring report describe an issue during the crossing process through the line of contact at the five entry-exit checkpoints (EECPs) in Donetsk (Maiorske, Marinka, Hnutove and Novotroitske) and Luhansk (Stanytsia Luhanska) Oblasts. All statistics and analytics are giving in the type of diagrams and figures.

Similar to the data collected in February, government controlled areas (GCA) residents had far fewer reasons to travel across the line of contact than NGCA residents. The absolute majority of people surveyed while crossing the line of contact were permanently residing in the NGCA. This also coincides with the high number of people who cited the GCA as the destination of their trip.

The disaggregation of reasons for crossing remains relatively stable. Respondents were mostly traveling to the GCA to solve issues with documents, withdraw cash and avoid payment suspension due to the 60-day limit of being away from the GCA, while the most common reason to go to the non-government controlled areas (NGCA) was visiting relatives.

Changing weather and inappropriate maintenance of the road and pedestrian area at Marinka EECP provoked a significant rise of complaints (from 24.1% in February to 49.0% in March).
